Overview of Service Guidelines

Service Guidelines These Service Guidelines apply to anyone that visits Mahrnee's Place, uses the buy, sell, trade, or any of the other services available at Mahrnee's Place Additionally, all visitors must abide by our User Agreement, Copyright Policy, and our Policy on Privacy. Please take a moment to review our Policy on Privacy.

Can you use our Buy - Sell - Trade or Other Services?To use the buy, sell, trade or any services that are available at Mahrnee's Place or another other web site owned or under the control of Mahrnee's Place are only available to those visitors that can enter into a legally binding contract. None of the buy, sell, trade or any services available at Mahrnee's Place can be used by minors, anyone under of 18 years age, or any other visiter that would be legally prohibited from entering into a binding contract. Anyone under 18 years of age, must only participate in or use Mahrnee's Place through a parent or legal guardian that is qualified to use this site.

Viewing, Cataloging, and Purchasing Directly from Mahrnee's Place At this time, Mahrnee's Place does not offer a Buy - Sell - Trade service through which Registered Members may participate in these activities with other Registered Members. This option is currently under construction and we hope to have it available to you very soon. Until that time, please continue to enjoy the Pin Pictures and the Pin Value Guide. We are also constructing another free service that will add Pin Values from our Pin Value Guide directly to your Pin Portfolio with the click of a mouse. Watch our What's New page for updates. Our guidelines for use will be published as soon as the Buy - Sell - Trade option is available.

Please report violations of Mahrnee's Place Service Agreement Violations of this Service Agreement or misuse of Mahrnee's Place will not be tolerated. Please report any allegations of misuse or any activities that appear fraudulent to Agreement Violation notice at Mahrnee's Place Mahrnee's Place will not and cannot release any information whatsoever regarding registered members nor will Mahrnee's place offer any dialog regarding activity between members. However, Mahrnee's place will release any and all information to law enforcement agencies. Please take a moment to review our Policy on Privacy.

Membership Registration Guidelines

Registration At Mahrnee's Place You must Register to use the Buy - Sell - Trade Services provided by Mahrnee's Place It is not required to Register to view the Pin Pictures or review the Pin Value Guide...we hope you will though, we like to know all of our pin friends. At this time, registering is free, you will not need to divulge your credit card information nor will you need to buy anything. For those visitors that choose to Register, you will be giving Mahrnee's Place information about yourself that will allow you to more fully utilize our site. When you have completed your Registration, you will receive a Thanks For Registering e-mail from us. We will verify your User ID and provide you with a confirmation code and a unique password.Register Now! Just FYI, when Mahrnee's site is finished with all construction, it will be required to Register. Without registration, you will not be allowed to Buy - Sell - Trade with Registered Members that will have many wonderful items for you to look at.

Receive Newsletters As a Registered Member, you will be assured of receiving e-mail notices that update these Guidelines. You may also choose to receive the Mahrnee's Place newsletter or other promotional news distributed by Mahrnee's Place Please rest assured that your personal information is handled in accordance with our Policy on Privacy and we will not offer any information about you for sale.

Mahrnee's Place Service Fees Register Now for FREE! Remember that when Mahrnee's Place is finished construction and you wish to Buy - Trade - Sell with other Registered Members, you will be required to register.

No Fees Currently, there is no fee for using Mahrnee's Place to view and enjoy the Pin Pictures and the Price Value Guide. Please enjoy our site.

To Close Your Membership Account Registered members may request their membership to be terminated at any time. Watch for updates here, as our construction ends and Mahrnee's Place Buy - Sell - Trade Services are all in place, we will be making changes to how Members may close accounts. For now, just send us an e-mailClose Account. Be sure to include your registered email address, your User ID, and your reason for closing.

Membership Responsibilities and Obligations

Provide True and Complete Information All Mahrnee's Place Members agree to provide true, complete and accurate information about themselves when completing the Mahrnee's Place registration form. Member registrations displaying incomplete or inaccurate information will be suspended until such information is obtained from the member and properly entered into their membership account.

No Spamming Members and all Users agree to refrain from any form of 'spamming'. In case you don't know what that is; it is sending unsolicited offers to purchase goods, chain letters or other commercial email to other internet users. DO NOT DO IT!! Members and all Users may not 'harvest' or use 'robots' to gather e-mail addresses or other information or images from any of the Mahrnee's Place web sites, for solicitation or other offers of any type.

Use of Mahrnee's Place All Member agree that in using the Mahrnee's Place Buy - Sell - Trade Service, including, but not limited to, price guide searches, portfolio creation and maintenance, buying and selling of merchandise, they will not violate any applicable local, state, federal and/or international laws, statutes, ordinances and/or regulations. Additionally, the solicitation, advertisement, sale or any exchange of counterfeit goods and other illegal items are expressly prohibited.

Offer merchandise or services that infringe or violate anyone's rights of privacy or publicity.
Request Members to perform an illegal activity or procure merchandise or services in an illegal manner.
Constitute transfer of Stolen merchandise.
Constitute transfer of live animals.
Offer Merchandise or services, which if sold through us, would cause us to violate any applicable local, state, federal or international law, statute, ordinance or regulation or cause undue risk to our systems.

Refusal of Service Mahrnee's Place reserves the right to refuse service to anyone. Mahrnee's Place will exercise this right at its descretions with all Members. In addition, Mahrnee's Place reserves the right to refuse service to Members whose member account information is incomplete, inaccurate or untrue. If a Member is suspended by Mahrnee's Place, that individual may not register again. Mahrnee's Place may, at its sole discretion, terminate Buy - Sell - Trade Service should Member's conduct fail to conform to these or any of our Terms and Conditionsof Service.

Working With The WWW The Internet can be an unstable and, sometimes, insecure marketplace. At times the Buy - Sell - Trade Service may not be available or offers may not be processed or may not be accepted for reasons beyond our control. In these circumstances we accept no responsibility. Please refer to our Disclaimer of Warranties below for further information.

Notice of Illegal use Mahrnee's Place cannot guarantee that it will notice or be able to prevent any illegal or inappropriate use of the site nor can Mahrnee's Place guarantee that it will give notice of any illegal or inappropriate use of any of the Mahrnee's Place web sites.

Cannot Perserve Records Mahrnee's Place cannot guarantee the preservation of any record and may expire information at its sole discretion and without notice.

Service Guidelines and Terms and Conditions

Terms and Conditions Members and Users Must Acknowledge and Accept the Buy - Sell - Trade Service and the Terms and Conditions of Mahrnee's Place. The Buy - Sell - Trade Service -"Service"- is provided to you under the following Terms of Service and any operating rules and/or policies that may, from time to time, be published by Mahrnee's Place as described below (all such Terms of Service, operating rules and/or policies shall hereinafter be referred to as "Service". This agreement -"Agreement"- and the Terms of Service comprise the entire agreement between the Member and Mahrnee's Place as relates to buying, selling, and trading through any or all of Mahrnee's Place web sites and supersedes all prior agreements between the parties, regarding the subject matter contained herein. By participating in the registration process for the Service, you expressly agree to be bound by this Agreement and these Terms of Service as well as any other Terms of Service related to general membership.

Member Account, Passwords, and Security Issues Once you become a member at Mahrnee's Place, you will receive a user name and a password. You are entirely responsible if you do not maintain the confidentiality of your user name and password. Furthermore, you are entirely responsible for any and all activities, which occur under your user name and password. Member agrees to immediately notify Mahrnee's Place of any unauthorized use of Member's user name or any other breach of security known to Member.

Disclaimer of Warranties As a Member, you expressly agree that the use of the Mahrnee's Place web site is at the sole risk of the Member. The Service is provided on an 'as available' and 'as' basis. Mahrnee's Place expressly disclaims andy and all waranties of any kind, whether express or implied. Including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringment.

Mahrnee's Place makes no warranty taht the service will meet your requirements, or taht the service will be uninterrupted, timely, secure or error free. Nor does Mahrnee's Place make any warranty as to the results that may be obtained from the use of this service or as to the accuracy or the reliability of any information obtained through this service or that defects in the software will be corrected.
Mahrnee's Place makes no warranty regarding any goods or services purchased or obtained through this service or any transactions entered into through this service.
No advice or information, whether oral or written, obtained by any Member from Mahrnee's Place or through the use of this service will create any warranty not expressly made herein.

Limitation of Direct or InDirect Liability

Limitation of Liability Mahrnee's Place will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or inability to use this service. Nor for the cost of procurement of substitute goods and services or resulting from any goods, or services purchased or obtained, or messages received or transactions entered into through this service. Or resulting from unatuthorized access to or alteration of members transmissions or dat, including but not limited to damages for loss of profits, use, data or other intangible, even if Mahrnee's Place has been advised of the possibility of such damages.

No resale or Commercial Use of this Service The Member's right to use the Service is personal to each Member. The Member agrees not to resell or make any commercial use of this Service, without the express written consent of Mahrnee's Place.

Copyright Acknowledgment Member acknowledges that content appearing on this Service may be protected by copyrights, trademarks or other proprietary or personal rights and that the Member's use of such content will be governed by the laws which create those rights and provide for their enforcement. The Member agrees that without the prior written consent of Mahrnee's Place, Member shall not resell the Service or use the Service for the transmission of commercial solicitations or for the receipt of responses to commercial solicitations. Member agrees not to, for a commercial purpose, upload, transmit, reproduce, distribute or participate in the transfer or sale, or in any way exploit, any content obtained through the Service. Member agrees not to use the Service for the transmission of (or receipt of responses to) chain letters, lotteries, gambling or pyramid schemes of any kind. Member agrees not to use the Service to disseminate any message in a broad-based mailing without the prior written permission of Mahrnee's Place. Member agrees not to forge communications or take any other action that would disguise the origin of communications you transmit through the Service. Member agrees not to permit another person to transmit communications that falsely identifies the Member's account as the original of such communication.

Conduct of Members Guidelines

Conduct Limitations of Member Mahrnee's Place retains all the rights at Mahrnee's Place and at its sole discretion, will determine whether or not a Member's conduct is consistent with the letter and spirit of the Buy - Sell - Trade Service Conditions and may terminate at any time a Member's conduct is found to be inconsistent with these Buy - Sell - Trade Service Conditions.

Conduct of Member The Member is solely responsible for the contents of his or her transmissions and correspondence to Mahrnee's Place through the Buy - Sell - Trade Service. The Member's use of the Buy - Sell - Trade Service at Mahrnee's Place is subject to all applicable local, state, national and international laws and regulations.

The Member agrees to (1) to comply with US law regarding the transmission of technical data exported from the United States through the Service (2) not to use the Buy - Sell - Trade Service for illegal purposes (3) not to interfere or disrupt networks connected to the Buy - Sell - Trade Service (4) to comply with all regulations, policies and procedures of networks connected to the Buy - Sell - Trade Service.

Un Acceptable Behavior The Member agrees not to transmit through the Buy - Sell - Trade Service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. The Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited. Mahrnee's Place may, at its sole discretion, immediately terminate the Buy - Sell - Trade Service should the Member's conduct fail to conform to these Terms and Conditions of Service.

Fraudulent Insurance Claims The Member further agrees not to use the Buy - Sell - Trade Service in a manner that violates any federal, state or local laws or statute, including but not limited to the sale of regulated substances to minors or the filing of fraudulent insurance claims.

Mahrnee's Place Release and Indemnifications

Release and Indemnification The Member hereby waives, releases, forgives, discharges and relinquishes any and all claims that Member now has or may have against Mahrnee's Place, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives which are connected with, arise out of, relate to or are incidental to any Mahrnee's Place transaction.

Member hereby agrees to indemnify, defend and hold Mahrnee's Place, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives harmless from and against any and all claims, loss, damage, tax, liability and/or expense that may be incurred by Mahrnee's Place, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives arising out of or in connection with the performance of its duties as described in this Agreement (except as caused by its gross negligence or willful misconduct) including the legal costs, fees and expenses of defending itself against any claim by any or all of the parties to any Mahrnee's Place transaction and/or by any other person and/or as a result of the Member taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.

Member further agrees to indemnify and hold all Mahrnee's Place respective web sites, its affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Member's use of the Buy - Sell - Trade Service, the violation of these Terms and Conditions by Member, or the infringement by Member, or other user of the Buy - Sell - Trade Service using Member's computer, of any intellectual property or other right of any person or entity.

Suspension or Termination of Membership

Reservation of Right to Suspend Enrollment Mahrnee's Place reserves all rights to suspend any members enrollment with Mahrnee's Place Should the Member object to any of these Buy - Sell - Trade Service Terms and Conditions or any subsequent modifications thereto or become dissatisfied with the Service in any way, the Member's only recourse is to immediately: (1) discontinue use of the Mahrnee's Place web site Service (2) terminate membership in Mahrnee's Place (3) notify Mahrnee's Place of decision to terminate membership.

Advertisers and Advertiser Promotion

Mahrnee's Place, at its descretion may send via e-mail items that may be of interest to Members or Visitors of Mahrnee's Place. On-line advertising may be sold or made available to advertisers on Mahrnee's Place web pages. Any Member that participates in promotions of these advertisers, via correspondence, payment for and delivery of goods or services, any terms and conditions of the advertiser, including warranties and representations associated with the advertisers products are absolutely and completely only between the corresponding Member and the Advertiser. Mahrnee's Place will absolutely assume no liability, obligation or responsibility for any part of any such transaction, correspondence or promotion. Member also agrees to pay all sales, use, value-added, personal property or other governmental tax or levy imposed on goods or services, if any, that may apply to Member purchase.

It's the Law!!

Florida Law Rules. Mahrnee's Place Buy - Sell - Trade Service Guidelines and Conditions are governed by and construed in accordance with the laws of the State of Florida. The Member and Mahrnee's Place, agree to jurisdiction of the courts of the State of Florida. If any part of these Buy - Sell - Trade Service Guidelines is held by a court of competent jurisdiction to be contrary to law, then such part will be construed, as nearly as possible, to reflect the intentions of the parties with the other parts to remain in full force and effect. Should Mahrnee's Place fail to exercise or enforce any rights or provisions of these Buy - Sell - Trade Service Guidelines and Conditions that will not constitute a waiver of such right or provision unless specifically acknowledged and agreed to by Mahrnee's Place, in writing. The Member and Mahrnee's Place agree that any cause of action arising out of or related to this Buy - Sell - Trade Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred and Member and Mahrnee's Place forever waive any such cause of action. The section titles in these Buy - Sell - Trade Service and Conditions are solely used for the convenience of the parties and have no legal or contractual significance.
